Description

ARBITRATION We represent in Arbitration of disputes before Arbitration Tribunals, appointed retired judges, Bombay Stock Exchange, National Stock Exchange & Retired Judges and before concerned Courts of law, including the Hon’ble High Courts for matters under the provisions of the Arbitration and conciliation Act, 1996. We also would encourage our clients to go for Alternate Dispute Resolution (ADR) ALTERNATIVE DISPUTE RESOLUTION Alternative Dispute Resolution System Is The Ideal System Of Dispute Resolution. Mediation, A Form Of Alternative Dispute Resolution (ADR), Can Be An Inexpensive, Effective, And Peaceful Method For Resolving Conflict Between Two Parties Without Going To Trial. Mediation Is A Non-Confrontational Process That Involves A Neutral Individual (Usually An Attorney Or Retired Judge) Helping The Two Parties Come To A Mutually Agreed Upon Solution ADVANTAGES More Control Over The Outcome Mediation Serves As A Structured Process To Help Both Parties Negotiate Their Own Resolution, Empowering Everyone Involved. Mediation, In Particular, Allows Both Parties To Be More Creative And Flexible In Reaching A Settlement As Opposed To The Winner Take All Mentality That Happens When Going To Court. COST-EFFECTIVE The Value Of Going Through Mediation Or Some Form Of ADR Is That It Because The Time It Takes To Reach A Resolution Is Often Much Shorter, It Is Typically Far Less Expensive Than Litigating A Case Through A Trial. Also, Because Both Parties Are Participants As Opposed To Just Witnesses, There Is A Feeling Of Personal Satisfaction That Comes With Finding A Resolution Both Parties Are Satisfied With. Settlements Reached Can Feel More Reasonable Because They Have Been Agreed To By Both Parties, Instead Of Simply Awarded To One Side Or The Other.

SERVICES MATTER

CENTRAL ADMINISTRATIVE TRIBUNAL (CAT) The Central Administrative Tribunal had been established under Article 323 – A of the Constitution for adjudication of disputes and complaints with respect to recruitment and conditions of service of persons appointed to public services and posts in connection with the affairs of the Union or other authorities under the control of the Government. In the statement of object and reasons on the introduction of the Administrative Tribunals Act, 1985 it was mentioned: It is expected that the setting up of such Administrative Tribunals to deal exclusively with service matters would go a long way in not only reducing the burden of the various Courts and thereby giving them more time to deal with other cases expeditiously but would also provide to the persons covered by the Administrative Tribunals speedy relief in respect of their grievances. MAHARASHTRA ADMINISTRATIVE TRIBUNAL (MAT) In accordance with the provisions of Article 323A of the Constitution of India, Parliament of India, enacted Administrative Tribunals Act, 1985.
